December 1, 2024, Marks the Introduction of Export Security Regime: What Exporters Need to Know
Starting December 1, 2024, Ukraine is implementing an export security regime for certain export operations, as outlined in Cabinet of Ministers Resolution No. 1261 dated October 29, 2024. This new regulation affects the export of various agricultural and food products.
List of Goods Subject to the Regime
The export security regime applies to the following goods:
- Natural honey
- Walnuts in shell and shelled
- Wheat and meslin (a mixture of wheat and rye)
- Rye
- Barley
- Oats
- Corn
- Soybeans, whether or not broken
- Rapeseed or colza seeds, whether or not broken
- Sunflower seeds, whether or not broken
- Soybean oil and its fractions, refined or unrefined
- Sunflower, safflower, or cottonseed oil and their fractions
- Rapeseed or mustard oil and their fractions
- Oilcake and other solid residues from the extraction of vegetable or microbial fats and oils
Exceptions to the Export Security Regime
The regime does not apply to the export of these goods in the following cases:
- Goods exported as supplies by commercial transport vehicles according to Article 229 of the Customs Code of Ukraine.
- Goods under specific subcategories of the Ukrainian Classification of Goods for Foreign Economic Activity (UCGFEA) exported by VAT payers with a phytosanitary certificate.
- Goods exported as humanitarian aid provided by Ukraine.
New Declaration and Customs Clearance Requirements
From December 1, 2024, the provisions of Laws No. 3706-IX and No. 3707-IX come into effect, establishing special procedures for exporting certain goods under the export security regime.
Key changes include:
- Additional grounds for refusal in customs clearance of goods.
- Mandatory inclusion of information about the tax invoice registered in the Unified Register of Tax Invoices in column 44 of the customs declaration.
- When declaring goods in the additional declaration, it is necessary to indicate the code signifying completion of movement "84".
Minimum Acceptable Export Prices
The Ministry of Agrarian Policy and Food of Ukraine has approved minimum acceptable export prices for certain goods. These prices apply from the day following their publication on the official website of the ministry. Until new prices are published, the previous ones remain in effect.

- Verify the current minimum acceptable export prices on the official website of the Ministry of Agrarian Policy before processing customs documents.
- Prepare the necessary documents in accordance with the new requirements, including the tax invoice.
